Flexible Legal and Risk Manager. Construction. London. c£85K FTE, negotiable Our Client Our client are a specialist Engineering Contractor, specialising in innovative engineering and construction solutions. A privately owned business with an annual turnover of approximately £100 million, work encompasses world class, complex demolition, piling, civil engineering and reinforced concrete (RC) sub and super structure construction. Through a fully integrated offering, they design, develop and deliver bespoke and smart engineering solutions for the most prestigious public and private organisations in London. The Role This senior, stand-alone Legal and Risk Manager position has a broad scope, however is primarily tasked with providing the board of directors with sound legal opinion, making a clear distinction between Legal, Moral and Ethical obligations to allow the board to make decisions which are balanced with other competing business requirements. The role will also be required to (not limited to); To develop, maintain and operate Legal and risk processes To propose and operate legal limits of authority Maintain and support implementation of a project lifecycle risk management framework Provide training on contract terms, insurance, bonds and warranties Point of contact with bond broker for issuing new bonds Provide legal guidance and input on compliance policies. Perform audit of procedures to ensure demonstrable checks and balance are in place Oversee provision of appropriate compliance training Provide board with relevant legal updates in relation to legal obligations and governance. Pre Contract – advice to precon director on risks inherent in terms and conditions Confirm terms and conditions reflect what has been negotiated at point of contract signing Circulate ‘’traffic light’’ on agreed contract terms to board (MD/FD/CD) Advice to commercial director on risks inherent in terms and conditions (including bond and warranty wording) and support with agreeing them in accordance with our framework. Flag anything outside framework (or that uncomfortable with) in line with legal limits of authority Regularly [frequency as appropriate for site and risk profile] audit projects to assure compliance with contract administration Develop Contract Administration Manual [CAM]. Ensure contract terms and conditions are up to date and protect the business Regular support and review with project teams to help shape commercial strategy, manage risk and maximise opportunity in a strategically aligned manner Liaise with project teams and provide contractual advice associated with disputes Propose and execute legal strategy as agreed with Commercial Director Manage interaction [including scope setting and fee management] with external legal advisors associated with project disputes The Candidate Our client are ideally looking for a Legal and Risk Manager with similar, relevant experience, gained in a construction/similar business. Understanding and experience working with JCT and NEC forms of contract is essential and so is the ability to work in stand-alone function, operating amongst a team of senior business leaders. The Terms Our client are open to discussions with the right candidate and terms can be flexible. Ideally this role is being offered at approximately 35 hours per week to full time with the hours being worked ideally across 5 days, however again, there is flexibility for the right person on this. They are happy to look at a flexible start and finish time, depending on the needs of the candidate.
